Terms of Use and Privacy Policy 

Funterra™ is owned and operated by SMART Technologies ULC, all rights reserved. By using Funterra you, and if you are a minor, your parent or guardian, agree to these Terms:

  1. Privacy Policy. You consent to the processing and storage of your data in accordance with Funterra’s Privacy Policy.
  2. Using Funterra. We grant you a personal, non-exclusive, revocable, and non-transferable license to use Funterra. In exchange, you agree that you will not copy, modify, create a derivative work, sell, sublicense, or otherwise transfer any right in the content (videos, graphics, text, etc.) and software used in Funterra. Basically, all content belongs to Funterra and your subscription simply allows you access to view that content. If you misbehave, we will immediately (without notice) terminate your subscription and possibly seek legal action against you.
  3. No Warranty and Limitation of Liability. We reserve the right, without notice, to: (a) to modify, suspend, interrupt or terminate operation of, or access to, Funterra or any portion of Funterra, for any reason; and (b) to modify or change Funterra or any portion of Funterra, and any applicable policies or terms.

Furthermore, we do not promise that Funterra will be error-free, uninterrupted, or that any defects will be corrected, or that your use of the Funterra will provide specific results, like fun and laughter. Funterra and its content are delivered on an "as-is" and "as-available" basis. Funterra disclaims all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability, and fitness for a particular purpose.

EXCEPT WHERE PROHIBITED BY LAW, IN NO EVENT WILL FUNTERRA BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, EVEN IF FUNTERRA HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF, NOTWITHSTANDING THE OTHER PROVISIONS OF THESE TERMS OF SERVICE, FUNTERRA IS FOUND TO BE LIABLE TO YOU FOR ANY DAMAGE OR LOSS WHICH ARISES OUT OF OR IS IN ANY WAY CONNECTED WITH YOUR USE OF THE FUNTERRA, FUNTERRA' LIABILITY SHALL IN NO EVENT EXCEED THE TOTAL OF ANY SUBSCRIPTION FEES WITH RESPECT TO ANY SERVICE OR FEATURE OF OR ON THE FUNTERRA PAID WITHIN ONE YEAR PRIOR TO THE DATE OF THE INITIAL CLAIM MADE AGAINST US.

  1. Governing Law and Disputes. These Terms and your use of Funterra are exclusively governed, construed and interpreted in accordance with the laws of Alberta, Canada. Any disputes shall be exclusively settled in accordance with Alberta’s Arbitration Act. The United Nations Convention on Contracts for the International Sale of Goods does not apply and neither does conflict of laws principles.

Customers and users are two distinct groups:

  • Our customer for Funterra is typically a parent and in some cases might be a teacher or school district.
  • Our users like teachers, students or parents users are accessing the product because the customer has granted them access.
  • It is of course possible to be both a customer and a user, which is typically the case when someone buys our products for home use.

When viewing the below information please keep in mind the distinction between customers and users.

Customer Purchase Data Collected to Process an Online Funterra Order

SMART sells individual subscriptions for Funterra through two regional online stores: United States and Canada. Credit card purchases are processed by Stripe®. SMART never has access to your credit card number.  

Stripe and SMART are considered the data controllers when customer data is collected while selling a product or service directly to you via the online stores.   We require this customer data to allow us to sell and electronically deliver the product or service to you.

  • Purpose: Office 365 is an enterprise solutions platform, including our enterprise resource planning (ERP) software that SMART uses to manage its day-to-day business activities such as accounting, procurement, project management and supply chain operations, as well as our e-mail, PowerBI® (data visitation) and SharePoint® (document management), as well as all the other standard Microsoft Office software titles, like Word, Excel, etc.

  • Purpose: We use Salesforce for our customer relationship management (CRM) software solution. It helps us manage our relationships and interactions with customers (including support calls) and potential customers.

  • Required: No. You are asked and it is optional
  • Purpose: We use Amazon S3 for some of our support centre functions and the hosting of support call transcripts and recordings; calls are only recorded with your express consent

SMART is considered the data controller when data is collected while conducting marketing. Website cookie information is in its own section further below. Transactional e-mails relating to your product or service fall under the Customer Purchase Data Collected to Process an Online Funterra Order section. SMART does not sell its marketing data.

  • Purpose: We use Mailchimp to send transactional e-mails for software renewals and marketing e-mails for people who have expressly opted in to receive them

User Data Collected While Using Funterra

Funterra is a platform that offers games, videos and activities to classrooms and households. When users interact with content (e.g. viewing a video, playing a game, taking a quiz etc.) they are rewarded with points and achievements (gamification). The section below describes the data collected by the Funterra service in order to facilitate the gamification experience.

Cookie Information
